On November 21, the Spanish Ministry of Health has released a new draft Royal Decree to the public to update tobacco and related product regulations.
The Ministry of Health pointed out that this move is part of the Comprehensive Prevention and Control Plan for Tobacco Control 2024-2027, focusing on product content, quality and safety standards, and outer packaging requirements.
Mónica García, Minister of Health, emphasized that “one of the most prominent things brought by the royal decree is universal packaging, which will make all cigarette boxes the same. This is not a whim, and there is already sufficient scientific evidence that additional publicity in cigarette boxes is also harmful.”
The draft makes a series of amendments to the current Royal Decree No. 579/2017. These amendments require cigarettes and loose tobacco to be packaged in a unified manner to remove design elements and colors that attract consumers.
For nicotine-free vapes, it is stipulated that the ingredients, health warnings (such as “Consumption of this product is harmful to health”) and related instructions for use and storage must be marked.
At the same time, the draft restricts the use of flavorings in vapes, allowing only tobacco flavor.
In addition, two new product categories are introduced: nicotine pouches and heated herbal products, and safety, labeling and sales requirements are set for them.
Under the transitional arrangement, manufacturers have ten months to adapt to the new labeling, packaging and production standards, and companies have twelve months to sell existing inventory products.
