According to Naver on July 15, Park Sung-hoon, a member of the ruling National Power Party of South Korea, announced on July 15 that he had submitted an amendment to the Tobacco Business Act to the National Assembly, aiming to include nicotine liquid in the definition of tobacco to fill the regulatory gap in the current law. At present, nicotine liquid is not regarded as a tobacco product in the traditional sense because it contains synthetic nicotine produced by chemical synthesis methods, thus escaping relevant sales restrictions.

Park Sung-hoon pointed out that under the current law, nicotine liquid is not subject to tobacco-related taxes and fees, and there is no need to mark health warnings on the product; at the same time, the sales and promotion activities of such products on the Internet are not restricted, and the sales points set up around schools are not prohibited, which poses a risk of sales to minors.

Park Sung-hoon emphasized that although the discussion on the regulation of new tobacco products is still ongoing, tax losses and social disputes, especially the issue of youth smoking, have attracted widespread attention. He added: “The amendment aims to reduce the rate of vape use among teenagers and reduce the adverse effects of vapes around schools. We will work hard to push the bill through as soon as possible.”

The Ministry of Planning and Finance said it will decide whether to include synthetic nicotine vapes in the regulatory scope of the Tobacco Business Act after the Ministry of Health and Welfare and the Ministry of Food and Drug Safety complete relevant research. The study is expected to be completed in December, when the potential harm of synthetic nicotine liquids to human health will be evaluated.
